HeartMath® Companies — Trademark Guidelines
A trademark is a word, phrase, symbol or design or a combination of words, phrases, symbols or designs, that identifies and distinguishes the source of the goods of one party from those of others. The US Patent and Trademark office’s most common reason for refusal of registration is “the likelihood of confusion” between the mark of the applicant and a mark already registered or applied for registration. So it’s really important to use the trademark properly.
The HeartMath logo represents the HeartMath companies, and going forward, HeartMath Inc. and HeartMath Institute, collectively. For marketing activities, we will put the HeartMath logo on marketing documents, web pages, etc. without identifying which company is using it.
The HeartMath companies use the HeartMath brand for products, services, licenses, certifications, the “system”, etc. When the term “HeartMath” is used for these branded items, combine it with a noun to clarify:
Examples: HeartMath® programs cover a wide variety of topics. The emWave® unit is very user-friendly. Practice the Quick Coherence® Technique every day. Note: when using “technique” with a registered trademark, capitalize it, in-house preference.
TRADEMARK USAGE RULES – for protection of your trademark
1. ALWAYS use a trademark as an adjective, accompanied by an APPROPRIATE noun.
The integrity of a trademark requires that you do not join a trademark to other words, symbols, or numbers, either as one word or with a hyphen. Do not abbreviate a trademark. Do not use a trademark as a verb. Do not use a trademark as a noun. Never use a “plural” form of a trademark.
2. ALWAYS use the proper spelling and the proper trademark symbol
The trademark symbol ™ and the registered trademark symbol ® are best shown in superscript or subscript. If the symbols or superscript are not available, such as in email communications, use parentheses, e.g., (TM) or (R). The general rule is to use the symbol the first time the mark is used in both the title and the content of a document, email or web pages. The overall web site(s) will have a HeartMath Trademark Guidelines page. This page will be a list of all of the registered ® and owned but not registered ™ trademarks.
3. ALWAYS use trademarks and brand names in the ways they were intended to be used.
Trademarks and brand names exist to identify the source of specific products or services as determined by the owner and they should not be used otherwise. Consequently, the source of the product or service must be identified through use of acknowledgments (attributions) in any document produced by a third party that uses any of the HeartMath companies’ trademarks. An attribution statement in a document is usually in a small font size, at the end or on the copyright page at the beginning:

The same rules as above apply to trademarks owned by third parties.

Can I include a HeartMath trademarked techniques in my book?
We appreciate others wanting to share HeartMath’s techniques. Please feel free to share the HeartMath Quick Coherence® technique. To do this, we ask that you keep any reprint or inclusion of this technique word-for-word as it appears in the resource sections of our websites, HeartMath.com and HeartMath.org. Any appearance of this technique must include the registered ® trademark symbol next to the technique name and an attribution statement that says, “The Quick Coherence® technique was developed by and is a registered trademark of HeartMath.” In addition, please note that the steps for this technique may not be edited, adapted or rewritten.

Can I include any other HeartMath techniques in my book or on my website?
At this time, the Quick Coherence® technique is the only technique we allow to be included in non-HeartMath works. In some cases, a HeartMath Certified Professional may be granted permission to use an additional technique, but this is an exception and would require submitting a special written request.

Can I share a link to your free resources on my website in a digital article or book or on my social media pages?
Yes, please do feel free to provide a link to any of the HeartMath resource pages or any other pages on our websites. We have provided free HeartMath resources, videos, techniques and tools on both the HeartMath.com and HeartMath.org websites.

Can I use HeartMath images on my website or in my book or other digital or printed mediums?
Images seen on any of the HeartMath company social media pages and websites are licensed by the HeartMath companies from other sources, and these licenses are non-transferrable. For this reason, we are unable to grant permission for you to use these images.

I saw HeartMath images on Google Images; does this mean I can use them?
Many people believe that if they see an image on Google Images, it must mean that the image is considered public domain. This is often not the case. Many of these images are copyrighted and licensed by the HeartMath companies from other sources; these licenses are non-transferrable, and these images may not be used.

I want to use a HeartMath Institute science graphic. Do I need permission to use it?
Science graphics that appear in the HeartMath Institute research papers, website and scientific monograph illustrating research findings and processes or scientific concepts may not be used for commercial purposes or linked to false statements made in connection with the science graphic or HeartMath work and research. Most of the HeartMath science graphics may be used with the proper attribution in the context of other research works and editorial reporting. Please send your request for the science graphic with our copyright imbedded to info@heartmath.org. If your desired use is outside these parameters, please send an email to info@heartmath.org with a link to the research graphic you are requesting permission to use and explain the use you are inquiring about. Please allow 14 business days for a response to a permission request.

Can I write a book about HeartMath talking about how HeartMath’s trademarked techniques relate to my area of specialty and give the reader instructions and steps on how to use HeartMath techniques?
We are grateful that so many authors over the years have included mentions of HeartMath’s science, published research studies, case studies and our heart rate variability coherence technology in their books. While all of these types of mentions are welcome, you cannot write a book explicitly “about HeartMath” or one that includes training instructions on the HeartMath techniques. The exception to this is that you may include HeartMath’s Quick Coherence® technique in a book or article that you are writing. At this time, the Quick Coherence® technique is the only technique we allow to be included in non-HeartMath works. Can I teach HeartMath trademark techniques in my presentations, training programs or coaching/mentoring sessions?
HeartMath techniques are trademarked and taught through HeartMath books, live and online HeartMath training programs, in webinars and tele-summits and by our network of certified professionals. If you have not been certified by HeartMath or one of HeartMath’s licensed partners, you cannot teach HeartMath techniques in public settings, such as a public presentation, private or organizational training programs or workshops or paid coaching/mentoring sessions. However, we invite you to explore our certification opportunities , as one of these may be ideal for the type of work you do.

Can I translate a HeartMath book in my language?
While we love the idea of having HeartMath materials available in more languages, please understand that most of the books written by HeartMath have been produced with an outside publisher. Permission to translate must be granted by the publishing company itself. Please contact the publishing company’s foreign rights and translations department for the book you are interested in translating. Contact information for the publishers can be found by searching on the Internet.

I want to quote or use some content from a HeartMath book or HeartMath Institute Science Monograph in my own book; can I do this?
Understand that all of the content in any HeartMath book or HeartMath Institute Science Monograph is copyrighted. You may quote from a HeartMath book and/or monograph, with the exception of HeartMath’s trademark techniques. The quoted content may not exceed 150 words. In addition, the quote must be word-for-word as it appears in the original source and attributed to the full title of the book it is quoted from.

I read an article or blog post on HeartMath.com or HeartMath.org and I want to include it on my website, newsletter or email blast; can I do this?
We greatly appreciate people wanting to share this information. All of the content on HeartMath websites is copyrighted. You may provide the article link on your website, in a newsletter or email blast directing people to the full article on the HeartMath website. In addition to providing a link, you may provide a brief excerpt of the HeartMath article you are interested in sharing. The excerpt may not exceed 80 words from the original article with the explicit understanding and agreement that you will also provide a link to the full HeartMath article on the HeartMath website and/or blog.

I saw a HeartMath video and I want to put it on my website; how can I do this?If we have shared a video on one of the HeartMath YouTube Channels, there will most likely be an embed code provided under the share tab. If there is an embed code, you may use it to insert the video on your website. If there is not an embed code, then this video is not available for this purpose.

I saw your video on Facebook, Instagram, YouTube, LinkedIn or Twitter, and I want to share it on my own social media page; can you give me the file so I can do this?
If you saw one of our videos on a HeartMath social media page, you can share it from the HeartMath social media page by clicking the share button for that post. However, we cannot give you the video as a file.

I want to make a remix or new edit of a HeartMath video; can I do this?
We appreciate the creative and inspired ideas that come from people using HeartMath methods. Most HeartMath videos contain video and image content licensed by the HeartMath companies from another source. Due to this, we cannot grant permission for any remixes or edits, as these licenses are non-transferrable.

Thank you for wanting to share our content. If you have Internet access at your presentation, you should be able to show a HeartMath video from our YouTube channel. We cannot provide you with video files.
